Short Term Rentals in Las Vegas: What Is Actually Legal
Four jurisdictions, four sets of rules, and an HOA layer on top of all of them. Read this before you buy anything with Airbnb income in the plan.
First, Find Out Which Government You Are Dealing With
This is the step almost every out of state investor skips.
A Las Vegas mailing address does not mean you are in the City of Las Vegas. Most of what people call Las Vegas, including the Strip, Summerlin South, Spring Valley, and Enterprise, is unincorporated Clark County.
Nevada forced the issue with Assembly Bill 363 in 2021, which required local governments to regulate short term rentals rather than ignore them. Each one then wrote its own ordinance, and they do not match.
Unincorporated Clark County
Built a full licensing system in 2022 with distance buffers from resorts and from other rentals, plus a hard cap on total licenses. New applications have been paused.
City of Las Vegas
Requires its own permit and business license, with separation distances from other permitted rentals and from resort properties, plus a life safety inspection.
City of Henderson
Has its own separate ordinance and permit process. A Clark County or City of Las Vegas approval means nothing here.
North Las Vegas
Also runs its own program. Same rule: confirm the specific jurisdiction of the parcel before you assume anything.
Step one is always the parcel, not the ordinance. Pull the address on the Clark County Assessor’s site and confirm the jurisdiction. I have watched buyers read the wrong city’s rules for weeks.
The HOA Trap Nobody Warns You About
This kills more deals than the county does.
You can hold a valid permit from the city or the county and still be prohibited from renting nightly, because your homeowners association says so in its CC&Rs. A government permit does not override a private deed restriction.
Minimum stay requirements of 30 days or more are common in Las Vegas master planned communities, in guard gated communities, and in most of the high rise towers along the Strip corridor. Those rules exist independently of any city ordinance and they are enforceable.
Get it in writing from the association itself. Not from the listing agent, not from the seller, not from a forum. Ask the management company to confirm the current minimum stay rule in writing during your due diligence period.
Where the Law Stands Right Now
Current as of August 2026, and it is genuinely unsettled.
Clark County’s short term rental ordinance has been the subject of ongoing litigation. In December 2025 a court paused enforcement of significant portions of the county’s penalty and licensing provisions while the case moves through appeal, and the county has continued to amend the ordinance since.
What that does not do is make short term rentals free of rules. Transient lodging tax is a separate obligation and is still owed on bookings. Your HOA restrictions are also completely unaffected by any of it.
This section will age. The rules here have changed more than once a year for several years running. Verify the current status with the licensing authority for your specific jurisdiction, and talk to a Nevada attorney before you build an investment thesis on nightly income. Before You Buy for Short Term Rental
Six checks, in this order.
Confirm the jurisdiction
Pull the parcel record and find out whether it is the county, Las Vegas, Henderson, or North Las Vegas. Everything else depends on this.
Read the CC&Rs yourself
Search for minimum lease terms. If it says 30 days, nightly rental is off the table no matter what the city allows.
Check the buffers
Distance requirements from resorts and from other licensed rentals can disqualify a home that otherwise looks perfect.
Ask whether applications are even open
A licensing pause means the answer today may be no regardless of whether the property would qualify.
Budget the taxes
Transient lodging tax applies to bookings and is owed separately from any licensing question.
Run the long term numbers too
Plenty of owners here run the math both ways and land on a traditional lease. Fewer headaches, no licensing exposure.

Is Airbnb legal in Las Vegas?
It depends on which jurisdiction the property sits in and what the HOA allows. Short term rentals are permitted in principle across the valley, but every jurisdiction requires its own license or permit, imposes distance buffers, and limits how many licenses exist. Clark County’s licensing and penalty provisions have also been partly paused by litigation. Assume nothing until you have checked the specific parcel.
What counts as a short term rental here?
Generally a residential unit rented for 30 consecutive days or fewer. That is why so many HOAs set a 30 day minimum lease term. It puts the property outside the short term rental definition entirely, which is exactly the point.
Can my HOA stop me even if I have a license?
Yes. A city or county permit gives you permission from the government. It does not override the private deed restrictions in your community’s CC&Rs. If your association prohibits rentals under 30 days, that restriction stands and it is enforceable against you.
Are Strip high rise condos a workaround?
Usually the opposite. Most of the residential towers along the Strip corridor enforce minimum stay requirements in their governing documents specifically to prevent nightly rentals. A few buildings are structured as licensed hotel condominiums, which is a different animal entirely. Confirm the building’s rules before you assume.
Do I still owe taxes if licensing is paused?
Yes. Transient lodging tax on bookings is a separate obligation from the licensing dispute and continues to apply. Talk to a Nevada CPA about your specific filing requirements.
Should I just do a long term rental instead?
A lot of owners here reach that conclusion once they price in licensing, buffers, insurance, furnishings, turnover, and the legal uncertainty. A traditional lease trades the higher nightly headline for a stable tenant and none of the licensing exposure. Run both sets of numbers before you decide.
